I’ll give you three examples, involving very different facts:

1) Maryland criminal law example.

Let’s say you are arrested for some serious offense, attempted murder, near Annapolis. You are arrested and the police officer gives you the proper Miranda warnings. After you exercise your right to an attorney, you are placed in a holding cell. You ask for a phone call, and the officer obliges. You call your friend, who tells you that you are all over the local news. You have been arrested for attempted murder. You tell your friend that they have no proof. You hid the murder weapon in a car and drove the car over a cliff into the water.

The cops have you. You said something. Even though this isn’t the typical situation that we see in the movies, you still had a right not to say anything. When they said, “anything you say,” they meant anything you say. Jail phone calls are almost always monitored and recorded. You didn’t have to make that call, and you would have been exercising your right to remain silent.

2) Virginia criminal law example.

You are involved in an accident on I-66. An eighteen-wheeler taps you from behind, the driver blows the horn, and then speeds off. You call the police. When they arrive, you tell the officer that the truck driver cut you off and you veered into the jersey wall. You then proceeded to drive in front of the truck and slow down, in an attempt to get the driver to stop because he caused an accident. At least that was your thinking. The cop then gives you a ticket, because this kind of driving is considered reckless in some states.

Again, you didn’t have to say anything to the cop. Ignorance of the law (meaning you didn’t know that what you did is reckless driving) is not an excuse. Besides, what advantage are you gaining from saying anything to the police officer?

3) DC criminal law example.

Suppose you are driving home from happy hour near the Verizon Center and you get pulled over. The cop tells you that your taillight was out. He then proceeds to tell you that he smells a distinct odor of alcohol emanating from your breath. The magic words. He asks you if you’ve been drinking. Every time a file comes into my office, it is scanned and labeled with the date, the party name, and a short description of what it is. So, for example, if I filed a notice of appearance on myself, today, it would look like this: 10-06-15 – Small – NOA. The reason the year goes first is so that everything gets listed chronologically. Some cases actually span years!

Once they are scanned in, I put the files in a cloud computing like place called dropbox. I think the first 2 gigabytes of memory are free, and then it’s like $10 a month to get 10 gigs if you need it. They key, though is that it is available wherever you have wifi, and the files on your computer are accessible even if you don’t have wifi (like me, for example, writing this entry on the plane in mid-air). When you want to save a file to dropbox you just drag it into the dropbox folder. You can give permissions to people to allow them to access certain folders, and everyone can get the files whenever they need them.

I also have a Google voice number. What a Google voice number allows me to do is have one central number for my criminal law practice that I can then forward wherever and whenever I need to. I can send it to my cell phone if I’m out of the office, another number where I know I’ll be, or anywhere else. That means I can be a criminal lawyer on the go, at all times. And if someone leaves a message, it is immediately forwarded to my email both as a text and audio file. I can listen to the message right from my email!

THE HORIZONTAL GAZE NYSTAGMUS TEST

The Horizontal Gaze Nystagmus (HGN) Test is the test which the officer puts his or her finger in front of the suspect’s eyes and waives them around. Unfortunately for many drunk driving defendants, their lawyers do not understand how the officer is supposed to properly perform the test, nor do they realize what the officer is looking for. Nystagmus is an abnormal jerky movement of the eye. There is some questionable academic literature which finds that people with blood alcohol levels over the legal limit will have the presence of nystagmus in their eyes.

Prior to the performance of the test, the officer is required to check for “equal tracking” of the eyes by moving their finger or another object quickly across the face of the drunk driving suspect. Equal tracking means that the eyes have to move in uniform and at the same speed. Next, the officer is required to check to make sure the drinking and driving suspect’s pupils are of equal size. Finally, the officer is required to ask questions to the suspect regarding having any ailments which may result in a false positive on the HGN test.

The actual HGN test is then performed. The test itself consists of a six point system in which three different tests are performed on each eye, and if the sum of failed tests equals four or more points, the suspect is considered to have failed the test. Here are the tests as follows:

LACK OF SMOOTH PURSUIT – The officer moves the object slowly but steadily from the center of the subject’s face towards the left ear. The left eye should smoothly follow the object, but if the eye exhibits nystagmus, the officer notes the clue. The officer then checks the right eye.

DISTINCT NYSTAGMUS AT MAXIMUM DEVIATION – Starting again from the center of the suspect’s face, the officer moves the object toward the left ear, bringing the eye as far over as possible, and holds the object there for four seconds. The officer notes the clue if there is a distinct and sustained nystagmus at this point. The officer holds the object at maximum deviation for at least four seconds to ensure that quick movement of the object did not possibly cause the nystagmus. The officer then checks the right eye. This is also referred to as “end-point” nystagmus.

ANGLE OF ONSET OF NYSTAGMUS PRIOR TO FORTY-FIVE DEGREES – The officer moves the object at a speed that would take about four seconds for the object to reach the edge of the suspect’s left shoulder. The officer notes this clue if the point or angle at which the eye begins to display nystagmus is before the object reaches forty-five degrees from the center of the suspect’s face. The officer then moves the object towards the suspect’s right shoulder. For safety reasons, law enforcement officers usually use no apparatus to estimate the forty-five degree angle. Generally, forty-five degrees from center is at the point where the object is in front of the tip of the subject’s shoulder.
